Privacy Policy

The Department: Arts and Culture subscribes to and complies with the voluntary privacy principles contained in the Electronic Communications and Transactions Act 25 of 2002 as evidenced by and manifest in this Privacy Policy.

Status, Application and Amendment

1.1

This Privacy Policy forms part of the Terms and Conditions of Use of this portal and is incorporated in such Terms and Conditions of Use, albeit published as separate material on the portal.

1.2

The Privacy Policy applies to the Department: Arts and Culture and any legal entity that controls, verifies or makes use of information that may be collected via this portal.

Collection of personal data

2.1

Where personal information (such as your name, telephone number and e-mail address) is submitted to the portal by the user, for example by transmission of an electronic communication (sending an e-mail), subscribing to a service or completion of required fields on an electronic form, the following principles are observed in the handling of that information:

This portal collects, collates, processes and stores only such personal information regarding users as is necessary to provide the services offered.  The specific purpose for which information is collected is apparent from the context in which it is requested.

This portal will not use the personal information submitted for any other purpose other than the efficient provision of services, including this portal and services offered through it by third parties, without obtaining the prior written approval of the user or unless required to do so by law.

2.1.3

This portal will keep records of all personal information collected and the specific purpose for which it was collected for a period of at least five years from the date on which it was last used.

This portal will not disclose any personal information regarding a user to any third party, unless the prior written agreement of the user is obtained or the portal is required or permitted to do so by law.

If information is released with the user’s consent, this portal will retain a record of the information so released, the third party to which it was released, the reason for the release and the date of release, for a period of five years.

This portal will destroy or delete any personal information under its control that has become obsolete.

Note that, as permitted by the Electronic Communications and Transactions Act Act, this portal may use personal information collected to compile profiles for statistical purposes.  No information contained in the profiles or statistics will be able to be linked to any specific user.

Collection of anonymous data

3.1

Data messages, including e-mail messages, sent by users to the portal, utilise standard technical mechanisms considered as best practice to facilitate transmission routing.  Additionally, in order to provide the best possible and most relevant service, this portal may use standard technology such as cookies to collect information about the use of this site.  This technology is not able to identify individual users but simply allows this portal to collect statistics.

This portal utilises session or temporary cookies.  A cookie is a small file that is placed on the user’s hard drive in order to keep a record of a user’s interaction with this portal.  Session cookies are deleted once the user closes his or her browser software.

Cookies from this portal allow the portal owner to tailor services to your displayed preferences.

3.2.2

Cookies by themselves cannot be used to personally identify users but will be used to compile anonymous statistics relating to use of the services offered or to provide the portal owner with feedback on the performance of this portal.

If personal information has been submitted to this portal, users who wish to review their personal information may do so by editing their personal profiles directly through the facility provided for this purpose on the portal, subsequent to login.  Alternatively, users may request such a review through the feedback link.

Users who have any problem accessing their profiles, or would like to request a copy of their personal information may contact the portal owner using the feedback link.  In all cases, the Department: Arts and Culture will treat requests to access information or change information in accordance with the applicable legislative requirements, including the Promotion of Access to Information Act  2 of 2000 as amended.

The Department: Arts and Culture has no control over and accepts no responsibility for the privacy practices of any third party websites and portals to which hyperlinks may have been provided and we strongly recommend that you review the privacy policy of any such website and portal you visit before using it further.

Nothing contained herein creates or is intended to create a contract or agreement between the Department: Arts and Culture and any user visiting this portal.
